Tinify.ai is a software-as-a-service (SaaS) platform that enables users to:

• Upload and optimize images using AI-powered compression technology
• Upscale images using advanced AI algorithms (Real-ESRGAN)
• Generate SEO-optimized metadata and alt text automatically
• Convert between different image formats (PNG, JPEG, WebP, etc.)
• Process images in batches for efficiency
• Access our API for programmatic image optimization

3. User Accounts

Account Creation

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.

Account Responsibilities

• You are solely responsible for all activities under your account
• You must immediately notify us of any unauthorized use
• You must be at least 18 years old to use our Service
• One person or legal entity may maintain only one account

4. Acceptable Use

Permitted Use

You may use our Service for lawful business and personal purposes in accordance with these Terms.

Prohibited Activities

You agree NOT to:

• Upload images containing harmful, offensive, illegal, or copyrighted content

• Upload images containing personal data of individuals without consent
• Use automated means to access our Service without permission
• Resell or redistribute processed images without proper licensing

5. Content and Intellectual Property

Your Images

You retain ownership of images you upload. By using our Service, you grant us a limited license to process, optimize, and temporarily store your images as necessary to provide our Service. We automatically delete your images according to our retention policy.

Our Intellectual Property

The Service, including software, design, text, graphics, and trademarks, is owned by One Punch Technology, Inc. and protected by intellectual property laws.

6. AI Processing and Third-Party Services

Our Service uses AI technology and cloud processing services. You acknowledge that:

• AI processing results may vary based on image characteristics
• We use reputable third-party AI services bound by strict data agreements
• Third-party service availability may temporarily affect our Service
• We continuously improve our AI algorithms, which may affect processing results
• You are responsible for ensuring uploaded images comply with applicable laws

7. Subscription and Payment

Subscription Plans

We offer various subscription plans with different image processing quotas and features. Current pricing and plan details are available on our website. Usage is measured by the number of images processed per month.

Payment Terms

• Subscription fees are billed monthly in advance
• Additional image processing beyond your plan limit incurs per-image charges
• All fees are non-refundable except as required by law
• We may change pricing with 30 days' notice to existing subscribers
• Failure to pay may result in service suspension and image deletion

8. Service Availability

We strive to provide reliable service but do not guarantee 100% uptime. We may temporarily suspend the Service for maintenance, updates, or other operational reasons.

9. Termination

By You

You may terminate your account at any time through your account settings or by contacting us.

By Us

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for other reasons at our sole discretion.

10. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Indemnification

You agree to indemnify and hold us harmless from claims arising from your use of the Service, violation of these Terms, or infringement of third-party rights.
